The bill seeking to amend the existing Labor Code of the Philippines geared to stop abusive forms of Contractualization, also known as Endo, is ready for signing by President Rodrigo Duterte.
As the principals in the contracting relationships, employers are not liable for the claims of individuals deployed by contractors since these persons are not their employees. However, there are pitfalls, which if companies fail to avoid, can make them liable for various employment claims as if the workers of contractors are their employees.
Mistakes committed in dealing with contractors will jointly and severally make companies liable as in cases of illegal dismissal, back wages, reinstatement, separation pay and other money claims, so with social legislation benefits, among others. This can cost the organization millions of losses when left unresolved.
Misconceptions due to erroneous interpretation of the Basic Labor Law concepts will result to erroneous processes and interventions. In this freshly-cut learning session, our labor experts will prepare business owners and outsourced service contractors of what’s up and on as regard laws and regulations on valid and permissible Contracting and Subcontracting. They will share the technicalities, insights, good practices, tips, and strategies to avoid these pitfalls. Further, they will answer lingering questions such as: When is there an established employer-employee relationship? At what conditions is contracting allowed? What are the minimum legislated benefits required of an employer? What are the types of employment? When does the employee entitled to security of tenure?
